ORDER
Challenging the impugned Order passed by the trial Court in I.A.No.03 of 2024 in HMOP.No.1453 of 2022, the present Civil Revision Petition has been preferred by the petitioner.
2. The respondent/petitioner filed the Original Petition for dissolution of the marriage performed between the petitioner and the respondent on 27.08.2021 on the ground of cruelty. During the pendency of the Original Petition, the respondent/wife has filed an application seeking interim maintenance of Rs.1,00,000/- till the disposal of the petition. The trial Court, considering the facts and circumstances, granted a sum of Rs.4000/- per month as interim maintenance to the respondent/wife till the disposal of the main petition. Aggrieved over the same, the petitioner has preferred the present Civil Revision Petition.
3. When the matter came up for hearing before this Court on 11.03.2026, this Court gave an opportunity to the petitioner and the respondent to settle the dispute between them. When the matter is taken up today, it is seen that there is no possibility to settle the issue between the parties.
4. The petitioner being wife filed the application seeking interim maintenance stating that the respondent is the working in US and he is drawing a monthly salary of more than Rs.2 lakhs. Whereas, it is the contention of the respondent that the petitioner is educated and she is having sufficient source of income to maintain her and she is also having properties as per the assets and liabilities filed by her before the trial Court.
5. Considering the facts and circumstances of the case, as the respondent/husband is working in US and earning decent salary and he is also having immovable properties at Palladam Village, this Court is inclined to enhance the interim maintenance from Rs.4000/- awarded by the trial Court to Rs.50,000/- and the same has to be paid by the respondent from the date of the Original Petition in HMOP.No.1453 of 2022 till the disposal of the Original Petition.
6. With the above directions, this Civil Revision Petition is allowed the impugned Order of the trial Court made in I.A.No.3 of 2024 in HMOP.No.1453 of 2022 dated 16.06.2025 is set aside. No costs. 25-03-2026 Index: Yes/No Speaking/Non-speaking order vrc
