This application coming on this day before this court for hearing the court made the following order: This application is filed to permit the applicant/plaintiff to file and mark the Xerox copy of the original documents listed in the schedule to the Judges https://hcservices.ecourts.gov.in/hcservices/ Summons as secondary evidence under Section 65 of the

Indian Evidence Act, along with the proof affidavit of the plaintiff.

2.This application is to receive the secondary evidence since the primary evidence has been lost in the flood. These documents are the Memorandum of Understanding between the plaintiff and the defendant and the communications between the plaintiff and the Bank, viz., Canara bank.

3. The Additional Master No.II, shall consider the nature of documents and receive the same under Section 65 of the Indian Evidence Act, subject to proof and relevancy. Accordingly, this application is ordered.
