The petition is filed seeking extension of time granted to petitioner for filing written statement in O.S.No.22 of 2017.
2. This Court, while disposing the C.R.P.No.1471 of 2021 which has been filed challenging the order passed by the Court below allowing the application to condone the delay in seeking to set aside the exparte decree, directed the petitioner to file the written statement within a period of six weeks from the date of the order. In the affidavit filed in support of the petition seeking extension of time, it was stated by the petitioner that she bonafidely believed the time limit of six weeks would start from the date of deposit of the costs as directed in the civil revision petition.
3. In view of the said reason given by the petitioner, this Court is inclined to extend the time by imposing cost on the petitioner.
4. The C.M.P.27716 of 2023 is allowed on condition that the petitioner shall pay a sum of Rs.5000/- (Rupees five thousand only) to the respondent as cost on or before 12.02.2024.The petitioner is permitted to file written statement before the Court below on or before 14.02.2024. nr 01.02.2024 https://www.mhc.tn.gov.in/judis
