The petitioner /A2 who was arrested and remanded to judicial custody on 19.09.2023 registered originally under Section 174 Cr.P.C and subsequently, altered to Section 306 of IPC, on the file of the respondent Police, seeks bail.

2.It is stated that A1 had borrowed a sum of Rs.2 lakhs from the deceased and when return was sought, there was a threat. The wife of the deceased had actually given a complaint regarding the threat. Subsequently, there was a further threat held out and owing to that, the deceased had committed suicide.

3.The earlier application for bail in Crl.O.P.No.22828 of 2023 had been dismissed by this Court on 05.10.2023. Even at that time, it has been observed that A3 was absconding.

4.A3 is still absconding.

5.The learned counsel for the petitioner stated that the petitioner is a senior citizen and he is a Panchayat President and stated that he has to give salary to all those who have working under him. 6.The payment of salary can be done by any person who is responsible and who keeps account. But so long as A3 is absconding, it may not be prudent to grant bail. vkr 7.But, however the fact that A3 is absconding had also been noted earlier. At this stage, this Court is not inclined to grant bail to the petitioner.
