ORDER

This writ petition has been filed seeking a direction to the first respondent police to provide protection for measuring the boundaries of the petitioner's land.

The case of the petitioner is that on an earlier occasion, when the officials concerned attempted to survey the land belongs to the petitioner situated at Manavur Village, the respondents 2 and 3 objected and prevented the same. Hence, the petitioner lodged a complaint before the first respondent seeking police protection for conducting the survey. However, no action has been taken on the complaint so far. Hence, the present petition has been filed. 2/4

3. Heard the learned Government Advocate (crl.side) appearing for the first respondent and perused the materials available on records.

4. On perusal, it appears that there is a civil dispute exists between the parties with regard to the rights over the immovable property. In such view of the matter, the petitioner is at liberty to approach the competent Civil Court and file an application under the Survey and Boundaries Act, impleading the respondents 2 and 3 as parties and seek the appointment of a Commissioner for measuring the property. So that finality will be reached and the same will bind on the respondents 2 and 3 also. In view of the above, I find no merit in this writ petition.
