CMP.No.20715/2022 in AS.No.323/2013 S.S.SUNDAR, J., and N.MALA, J., [Order of the Court was made by S.S.SUNDAR, J.,] The above miscellaneous petition is filed to bring on record Mrs.Nirmala, Kalpana, Vidhya and Aruna as legal heirs of the deceased 1st respondent by name Thiru.Marutha Kutty as respondents 3 to 6 in the above appeal suit.

2.It is stated that the 1st respondent in the Appeal Suit by name Marutha Kutty died leaving behind his son, the 2nd respondent herein and his wife and three daughters as his legal heirs. Though the 1st respondent died on 28.07.2022, there is no abatement as the 2nd respondent who is his son, is already on record. Hence, the present petition is filed to implead the wife and daughters of the deceased / 1st respondent as respondents 3 to 6 in the Appeal Suit.

3.This Court is convinced with the reasons stated in the affidavit filed in support of the miscellaneous petition and there is no dispute regarding the relationship of parties. 4.Hence, this Miscellaneous Petition is ordered.
