PRAYER:
Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Mandamus directing the fourth respondent herein to survey the petitioner's house site measuring 8 ft in length from north to south and 40 ft in breadth from east to west and bounded in the north by land of Krishnan, in the south by Rangasamy site, east by Kammalar street and west by house site of Rangasamy and having total measurement of 320 sq.ft, having patta no.141, comprised in survey no.118/1P new survey no.270/16, situated in Alathurai village, Alathurai post, Cheyyar Taluk, Tiruvannamalai district. O R D E R
This Writ Petition has been filed to issue a Writ of Mandamus to direct the fourth respondent herein to survey the petitioner's house site.
2. Heard the learned counsel appearing for the petitioner and the learned Additional Government Pleader appearing for the official respondents.
3. Since there is no adverse order passed against the private respondents R5 and R6 in this writ petition, notice to the private respondents is dispensed with.
4. In the light of the limited scope of prayer sought for in this writ petition and the submissions of the learned counsel on either side, this Court, without going into the merits of the case, directs the fourth respondent to consider the petitioner's representation dated 26.08.2023, after issuing notice the petitioner, fifth and sixth respondents herein, adjacent land owners of the four boundaries of the petitioner's land and interested parties/rival claimants if any, as the case may be and conduct enquiry and measure the land and pass appropriate orders on merits and in accordance with law.The abovesaid exercise shall be completed within a period of two months from the date of receipt of a copy of this order.
5. With the abovesaid direction, the Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
