(Old S.F.No.107) acquired an extent of 0.16.88 hectares to the respondents 4 & 5 or any other rival parties until disposal of civil suits pending on the file of the Hon'ble District Munsiff Court at Dharapuram in O.S.No.422 of 2008 and O.S.No.444 of 2008.

O R D E R

This Writ Petition has been filed forbearing the respondents 1 to 3 from settling the compensation amount to the respondents 4 & 5 for the land in new S.F.No.257/2 (Old S.F.No.107), which was acquired for the purpose of excavating water canal to the respondents 4 & 5 herein.

2. On instructions, the learned Special Government Pleader would submitted that already the entire compensation has been disbursed in favour of the respondents 4 & 5 herein.

While pending Writ Petition, the petitioner filed a petition in WMP.No.42738 of 2025 to amend the prayer as follows:- "directing the 3rd respondent to recover the compensation amount paid to the respondents 4 and 5 along with interest and to make the Civil Court deposit till disposal of Civil Suits in O.S.No.422 of 2008 and O.S.No.444 of 2008 and O.S.No.639 of 2019 now pending on the file of the Hon'ble III-Additional District and Sessions Court at Dharapuram instead of forbearing the respondents 1 to 3 from settling the compensation amount for the land in new S.F.No.257/2 (Old S.F.No.107) acquired an extent of 0.16.88 hectares to the respondents 4 & 5 or any other rival parties until disposal of civil suits pending on the file of the Hon'ble District Munsiff Court at Dharapuram in O.S.No.422 of 2008 and O.S.No.444 of 2008."

If the petitioner succeeds before the Civil Court in O.S.No.422 of 2008, O.S.No.444 of 2008 and O.S.No.639 of 2019 pending on the file of the III-Additional District and Sesions Court at Dharapuram, the petitioner can very well recover the compensation from the respondents 4 & 5 herein. Therefore, the petition for amendment of prayer filed in WMP.No.42738 of 3/6

2025 stands dismissed.

4. In view of the same, the prayer sought in the Writ Petition has become infructuous, since the entire compensation has been disbursed in favour of the respondents 4 & 5. Hence, this Writ Petition stands dismissed. No costs.
