ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case was registered in Cr.No.928 of 2016 for the alleged offences under Sections 294 (b), 323, 324, 354 and 506 (2) of I.P.C. The occurrence is said to have taken place on 15.08.2016. It is reported that the defactocomplainant is not found in the respective address and remains untraceable. The matter has been pending since 2016. It is further stated that accused A1 Page No.1 of 3

and A3 have died and A2 has been attending the Court. 3.Considering the nature of the allegation, and since the accused/A2 has been facing the case since 2016, any further continuation of the trial would impinge upon his right to a speedy trial of the accused and no useful purpose would be served.

4.Accordingly, the case in C.C.No.74 of 2017 of Judicial Magistrate Court, Palladam, Palladam Taluk, Tiruppur, stands quashed. This Suo Motu Transfer Case is disposed of.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
