This petition has been filed to condone the delay of 132 days in filing the above appeal.

2. Though this Court, vide order dated 07.11.2024, dispensed with the notice to the 1st and 2nd respondents, however, when the matter was taken up for hearing, Ms.C.Bhuvanasundari, learned counsel undertook to file vakalat on behalf of the 2nd respondent.

3. Thereby, Registry is directed to print the name of Ms.C.Bhuvanasundari, learned counsel for the 2nd respondent.

4. Though notice was served and the name of the 3rd respondent was printed in the cause list, however, none appeared on its behalf.

5. Heard learned counsel for the appellant as well as the 2nd respondent. 1/3

6. Being satisfied with the reasons stated in the affidavit filed in support of the petition, this Court is inclined to order this petition.

7. Accordingly this petition is allowed. Registry is directed to number the appeal, if it is otherwise in order and post the matter for admission.

8. It is underscored that in the eventuality of the appellant succeeding in the appeal to be taken on record, he would not be entitled to any interest for 132 days. 21.11.2024 skt 2/3
