ORDER

This Criminal Original petition has been filed to call for the records in connection with final report in CC.No.7005 of 2022 dated 24.06.2022 pending on the file of the learned Metropolitan Magistrate Court II, Egmore, Chennai and quash the same.

2.The learned counsel for the petitioner submitted that the first respondent has given a false case by suppressing the material facts and on which, the charge sheet has been filed against the accused for offences under Sections 406, 420 & 506(i) IPC., if the petitioner is subjected to trial without any reliable material that would only waste the time of the Court. 3.However, the learned Additional Public Prosecutor for the respondent submitted that the trial has already been commenced and the matter stands to post on 05.01.2023 for appearance of L.W.7 to L.W.10. 4.Since the trial is in half way, the petitioner is at liberty to raise all Page No.2 of 4

his points which he has raised here as his defense by participating in the trial.

With these observations this criminal original petition stands disposed of.
