P.Ramesh ....Defendants PRAYER: Plaint filed under Order VII Rule 1 of CPC r/w Order IV Rule 1 of the O.S.Rules, praying to pass judgment and decree against the defendants:- a) Directing the defendants jointly and severally to pay a sum of Rs.88,75,000/- (Rupees eighty eight lakhs and seventy five thousand only) together with interest at the rate of 30% per annum from the date of plaint till payment in full on the principal sum of Rs.50,00,000/- ; and b) Directing the defendants to pay cost of the suit. J U D G M E N T

The learned counsel for the plaintiff presented a Memo dated 12.06.2024 stating that the plaintiff and the defendants have amicably settled their dispute out of Court. Hence, the learned counsel for the plaintiff prayed to dismiss the suit as settled out of Court and seeks refund of Court fee as per rules.

2. The said memo filed on behalf of the plaintiff dated 12.06.2024 is taken on file and recorded.

3. The Civil Suit is dismissed as settled out of Court. There shall be no order as to costs. The plaintiff shall be entitled to refund of Court fee, subject to statutory deduction, if any, by following the procedure for refund.
