ORDER

This Criminal Original Petition has been filed to transfer the Investigation from the second respondent to the first respondent with respect to offences made out in Crime No.10/2025 on the file of the second respondent and to file the final report.

2. The petitioner is arrayed as an accused in a case registered in Crime No.10 of 2025 for the offences under sections 281, 125[a] and 106[1] of BNS. The case of the petitioner is that the petitioner was sitting on the bike in the corner of the road, when the offending vehicle came in a rash manner and hit the bus going to Melmaruvathu and then the petitioner and the bike behind the bus due to which the husband of the defacto complainant had succumbed to the injuries. The petitioner also sustained serious injuries in the accident. The second respondent even without enquiring about the accident, had registered the

case against the petitioner and he has been falsely implicated in this case. In this regard he had given representations to the respondents. However, the same has not been considered by the respondents. Hence, the present petition seeking aforesaid relief.

3. Considering the nature of allegations, particularly, the fact that the bike involved did not have any insurance, let the further investigation be conducted by the Deputy Superintendent of Police, Vandavasi and expedite investigation and file final report.

4. With the above direction, this Criminal Original Petition is disposed of.
