O R D E R

The present Criminal Original Petition has been filed seeking a direction to transfer the investigation in Complaint No.33 of 2025 from the file of the first respondent to the file of the second respondent.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) appearing on behalf of the respondents.

3. The brief facts of the case is as follows: The main grievance of the petitioner is that the accused in none other than the brother of the petitioner's husband. He impersonated her husband and executed the alleged power of attorney to one Mohan and had alienated the property situated at Avadi, for which, her husband had lodged a complaint and the same was taken on file by the learned Judicial Magistrate No.II, Poonamallee in C.C.No.153 of 2024. Following the same, the accused in the capacity of power agent of her husband on fraudulent power of attorney executed on impersonation of the petitioner's husband, had sold their joint property situated at Manamadurai, for which complaint, two proceedings were initiated and action was directed to be taken on the

accused. But no action has been taken so far. In the meanwhile, for the complaint lodged at Sivagangai, the petitioner has been called for enquiry and informed that on failure, the complaint will be closed. The petitioner being a widow and also due to ill health, could not able to attend the enquiry and hence, seeks to transfer the investigation.

4. The learned Government Advocate submitted that in this regard, already another case has been filed and taken on file in CC No.153 of 2024 by the learned Judicial Magistrate No.II, Poonamallee for the similar offence.

5. On a perusal of the case reveals that the primary allegations is with regard to the alleged forgery and impersonation which has been taken cognizance by the trial Court. Merely because the property has been dealt in a different districts based on power of attorney, there cannot be any further final report on the same cause of action. In view of the above aspects, the Criminal Original Petition stands dismissed.
