The Original Petition has been filed under Section 8(2) of the Hindu Minority and Guardianship Act, 1956 (Act 32 of 1956) read with Order XX1 Rule
2 & 3 of Original Side Rules, seeking permission to sell the 'B' Schedule mentioned property belonging to the minor, Nyra Iyyappan, as per the sale agreement dated 15.07.2024 for a sum of Rs.36,00,000/- in favour of Mr.V.Rahakrishnan, S/o.Varaghamurthy. The petitioner also seeks direction for the investment of the said sum in deposits or securities and permission to receive the accruing interest or dividends monthly for the maintenance of the minor. 2.
The reason stated in the petition for selling the minor's interest is not convincing. The petitioner states that the sale is necessary to meet out the marriage expenses of the minor at an appropriate age, though the minor is only 4 years old. The intention of the petitioner does not appear to be bonafide. Hence the Original Petition is dismissed.
