Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India for issuance of a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned order in N.K.No.7632/A2/2017 dated 26.07.2017 on the file of the 1st respondent and quash the same; consequentially direct the respondents to fix the petitioner's seniority at appropriate place i.e in Serial No.20 instead of Serial No.24 in the Seniority List dated 02.11.2011, by taking into consideration of the date of petitioner's appointment and his seniority fixed in the list dated 30.11.2004 and to give notional promotion to the post of Foreman from the year 2011-2012 with retrospective effect and to pay all monetary benefits to him.

When the matter was listed for hearing on 13.10.2022, none appeared on behalf of the petitioner. Thus, this Court passed an order, directing the Registry to list the matter on 17.10.2022 under the caption "For Dismissal".

2. Again, when the matter was called on 19.10.2022, there was also no representation on behalf of the petitioner. In order to give one more opportunity, this Court passed an order, directing the Registry to list this matter once again under the caption "For Dismissal" on 26.10.2022.

3. Even today also i.e on 28.10.2022, when the matter is called, there is no representation on behalf of the writ petitioner. Thus, it is evident that the petitioner is not interested in pursuing the matter.

4. Accordingly, the Writ Petition in W.P.No.23444 of 2017 stands dismissed for non-prosecution. No costs.
