Respondents Prayer:- Writ Petition filed under Article 226 of Constitution of India for the issuance of Writ of Mandamus, directing the 1st respondent to consider the representation of the petitioner dated 30.09.2024 to cancel the layout approval as granted by the 1st respondent dated 28.06.2024 in his proceedings in Na.Ka. No.19120/2018/SeMa-3 and pass orders on the same.

ORDER

This Writ Petition has been filed for a direction, directing the 1st respondent to consider the representation submitted by the

petitioner dated 30.09.2024 seeking cancellation of layout approval in favour of the second respondent dated 30.09.2024 on the file of the 1st respondent dated 28.06.2024.

2. Heard the learned counsel appearing for the petitioner as well as the learned Special Government Pleader appearing for the 1st respondent and perused the materials available on record.

3. A perusal of the representation reveals that the second respondent owned a land admeasuring 1 acre 42 cents. However, he was granted layout approval for 1 acre 66 cents including the petitioner's land.

4. In view of the above, the first respondent is directed to conduct enquiry, after issuance of notice to the petitioner and the second respondent and after giving an opportunity of hearing to them pass orders on merits and in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order.

5. With the above direction, this writ petition stands disposed of. No costs.
