(By J.Nisha Banu,J.) This petition has been filed for a direction to the respondents to produce the body of the detenu / petitioner's son, namely, Ashik Rahman aged about 33 years and set him at liberty.

2. When the matter is taken up for hearing, it is represented by the learned Additional Public Prosecutor that the detenue, namely, Ashik Rahman, who is aged 33 years has eloped with a girl and he seeks further time to produce the detenue before this Court.

3. It is not the case of the petitioner that her son has been kidnapped and detained illegally for ransom. The detenue is not an illiterate person, as he is aged 33 years and he is said to have eloped with a girl. Hence, we are of the view that the question of illegal detention does not arise in this case, warranting issuance of Writ of Habeas.

4. Finding no ground for issuance of direction to produce the 2/4

detenue before this Court, this Habeas Corpus Petition is dismissed. No costs.
