ORDER

(1) Being frustrated by the non appearance of the learned counsel for the petitioner on the previous hearing date, the matte has been posted today under the caption ''for dismissal'' by my learned Predecessor.

(2) Again, there is no representation on behalf of the petitioner.

At any rate, even if there had been representation, the only information that could have been given to the learned counsel for the petitioner is that the 1st respondent Police has proceeded with the investigation and had prepared a Final Report for the offence under Section 420 read with 34 of IPC and had actually filed the same before the learned XI Metropolitan Magistrate, Saidapet, Chennai.

(3) In view of that particular fact that the present Petition has been filed to quash the FIR in Crime No.1122/2017 on the file of the 1st respondent police does not survive any longer. It would be advisable that the petitioner/A2 appears before the jurisdictional Magistrate Court on receipt of summons, after the said Final Report is taken cognizance by the learned Magistrate.

(4) The Criminal Original Petition stands dismissed accordingly.
