ORDER
Today, the matter is listed under the caption "For Being Mentioned".
2. It is stated that the earlier order was erroneous and the same is recalled and the following order is passed in this Suo motu TR.No.2660 of 2025:
"This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.
2.The case in C.C.No.195 of 2017 was taken on the file of the Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Page No.1 of 4
Tiruppur, for the alleged offence under Sections 392 of I.P.C. The occurrence is said to have taken place on 18.05.2016. The accused committed theft of defacto-complainant's gold chain. It is reported that the property involved in this case has been recovered and handed over to the defacto-complainant. The defacto-complainant does not want to pursue the case any further. There is no previous or subsequent case against the accused.
3.Considering the nature of the allegation, the antecedents of the accused and since the accused has been facing the case since 2017, any further continuation of the trial would impinge upon his right to a speedy trial of the accused and no useful purpose would be served.
4.Accordingly, the case in C.C.No.195 of 2017 of Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Tiruppur, stands quashed. This Suo Motu Transfer Case is disposed of." Page No.2 of 4
3. Therefore, Registry is directed to transmit the corrected order copy to the Court concerned.
13.10.2025 mp electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned.
