PRAYER: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents herein to consider the representations of the petitioner College to the 1st respondent on 04.01.2023, 13.05.2023 and 01.08.2023 seeking provisional affiliation to the petitioner college for B.Ed (2 years course) for the academic year 2023 to 2024 within the time frame fixed by this Hon'ble Court. Ms.A.V.Bharathi, learned counsel accepts notice for R1 and R2 and Mr.R.Thirunavukkarasu, learned counsel accepts notice for R3. They are armed with instructions to enable final disposal of this Writ petition, even at the stage of admission.

The short prayer of the petitioner is for a mandamus directing the respondents to consider the representations of the petitioner made before R1, being the Registrar of Pondicherry University on 04.01.2023, 13.05.2023 and 01.08.2023 seeking provisional affiliation to the petitioner college for B.Ed (2 years course) for academic year 2023 to 2024.
3. Ms.A.V.Bharathi, learned counsel for R1 and R2, on instructions, would submit that representations dated 04.01.2023, 13.05.2023 and 2/4
01.08.2023 could not be processed for the reason that they were only representations and not an application in the required format.
4. In fact, the petitioner had been apprised of the procedure to be followed and according to the learned counsel for R1 and R2, the format of the application had also been supplied to the petitioner. The petitioner has also filed an application on 23.10.2023 in the required format.
5. Some deficiencies are pointed out in the application itself. However, since the prayer of the petitioner is only for consideration of application for affiliation, this Court is not inclined to go into the merits or otherwise of the application, since that is the matter to be decided by the first respondent.
6. In light of the fact that the application has been filed very recently on 23.10.2023, learned counsel for R1 and R2 requested some time to hear the petitioner and pass orders on the application.
7. For this purpose, the petitioner will appear before R1, being the Registrar, Pondicherry University on 16.11.2023 at 10.30 a.m. without anticipating any further notice in this regard, since the date is fixed after ascertaining the convenience of the petitioner as well as R1. 3/4

8. R1 shall hear the petitioner, consider materials if any placed and pass orders on the petitioner's application dated 23.10.2023 on merits and in accordance with law, within a period of eight (8) weeks from date of first hearing.
