Writ Petition filed under Article 226 of the Constitution of India, to issue a Writ of Certiorarified Mandamus to call for the records culminated in the impugned order in No.4115/B3/-0448, dated 17.08.2004 issued by the respondent and to quash the same and to direct the respondent to permit the petitioner to vend judicial, non judicial and Court fee stamps as before and issue such other appropriate writ directions or as this Hon'ble High Court may deem fit and necessary in the facts and circumstances of the case.

O R D E R

The petitioner has filed this writ petition challenging the impugned order in No.4115/B3/-04-48, dated 17.08.2004 issued by the respondent, wherein, the petitioner's Vending Licence was temporarily suspended by invoking Rule 25(iii) of the Tamil Nadu Stamps Rules. Aggrieved by the same, the present writ petition has been filed.

If the petitioner is aggrieved by impugned order, the petitioner can prefer appeal before the Appellate Authority and without availing the appellate remedy approaching this Court under Article 226 of the Constitution of India is not sustainable one.

In view of the above, this Court is inclined to grant liberty to the petitioner to file an appeal before the Appellate Authority.

In the above terms, the Writ Petition is disposed of. No costs. Consequently, connected Miscellaneous Petition is closed.
