This Court, by an order dated 05.12.2022 directed the Judicial Magistrate No.II, Krishnagiri to dispose the case in C.C.No.137 of 2016 within a period of six months from the date of receipt of a copy of that order. Since the said case could not be disposed of within the time stipulated by this court, the court below by letter dated 29.01.2024 sought for extension of time. Hence, the matter is listed before this court today.
2. The Principal District Judge, Krishnagiri forwarded the letter dated 11.01.2024 submitted by the Judicial Magistrate No.II, Krishnagiri stating that the prosecution expressed difficulty in serving summons to the witnesses and returned summons along with VAO certificates for L.W.6, L.W.21 and L.W.23. Furthermore, the case was adjourned for more than 16 hearings for production of L.W.18, L.W. 20 and L.W.22, but the prosecution able to produce only one witness viz., L.W.19 on 10.01.2024 and returned summons with respect to other witnesses and to that effect, Village 1/3
Administrative Officer certificate was produced. So, as of now, only two more material witnesses and investigating officer alone have to be examined and the case was posted on 10.01.2024 and only due to non-production of witnesses, the trial court could not complete the trial within a stipulated time. Hence, he prayed to grant further time to dispose of the case.
3. Considering the request of the Judicial Magistrate No.II, Krishnagiri, this court is inclined to extend the time finally for the period of two months from the date of receipt of copy of this order to comply with the order of this court. However, time granted by this Court will not be extended after two months.
