ORDER

This civil revision petition has been filed to set aside the fair and decreetal order dated 26.09.2023 made in RLTA No.135/2022 by the learned III Additional Judge, City Civil Court, Chennai, thereby dismissing case in RLTOP No.91/2022 dated 05.09.2022 on the file of XII Judge, Court of Small Causes, Chennai.

2. When the matter is taken up for hearing, the learned counsel for the petitioner as well as the respondent informed before this court that, already possession of the property has been taken from the petitioner. Therefore, the prayer sought for in the civil revision petition has become infructuous and nothing survives for further adjudication in this civil revision petition.

3. Recording the submission made by the learned counsel appearing on either side, this civil revision petition is dismissed as infructuous No costs. Consequently, connected miscellaneous petition is closed. With regard to the arrears of rent and repayment of advance amount, liberty is granted to the parties to workout their remedy in the manner known to law.
