ORDER

This Suo Motu case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.)No.618 of 2025.

2. This case is registered for alleged offences under Sections 498(A), 294(b), 323 & 506(i) of IPC. The incident occurred on 24.09.2011. This matter pertains to a case of matrimonial discord between the parties. The Page No.1 of 3

husband being the first accused and the mother-in-law being the second accused are continuously attending the case and this occurrence is of the year 2011. It is submitted that in spite of best efforts, since the defacto complainant has gone to Andhra Pradesh, the case could not be proceeded. As such, as a special case in exercise of power under Article 226 of the Constitution of India, the case is closed for the present and if necessary, if they defacto complainant surfaces and necessity arises, the Police will be entitled to move the case.

4. Accordingly, the case in CC.No.100008 of 2012 on the file of Judicial Magistrate Court, Sriperumbudur Taluk, Kancheepuram stands closed and this Suo Motu Transfer case is closed.

The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
