ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The case, Cr.No.1422 of 2020 was registered for an alleged offence under Section 294 (b), 324 and 506 (i) of IPC. The incident occurred on 26.10.2020. The allegation in this case is that there was a wordy quarrel between the defacto complainant and the accused, due to which, the defacto complainant sustained simple injuries. The case is pending from the year 2022 and it is posted at the stage of summons. There is no previous or subsequent case as against the accused. Whereabouts of the accused and the defacto complainant could not be traced. Considering the factual matrix, the context of the case, any further continuation of the proceedings would impinge upon the right of the accused for speedy trial.

Accordingly, the proceedings in CC.No.115/2022 on the file of the JUDICIAL MAGISTRATE COURT, Sriperumbudur Taluk, Kancheepuram, is quashed and this Suo Motu Transfer Case is disposed of. 08.09.2025 Jer electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
