This petition has been filed to modify the condition imposed on the petitioner that he shall deposit a sum of Rs.2,00,000/- to the credit of Crime No.428 of 2022 and the defacto complainant is entitled to withdraw the amount deposited to the credit of Crime No.428 of 2022 in Crl.O.P.No.27529 of 2022 by order dated 14.11.2022.

2.The learned counsel for the petitioner would submit that the entire borrowal was paid by the petitioner through his hard earned money and she has also utilized the said bank borrowal under the false promise of marrying the petitioner after getting divorce. He would further submit that the petitioner will be put to much loss and hardship, if the above order permitting the defacto complainant to withdraw the amount to be deposited to the credit of Crime No.428 of 2022. Thereby, he seeks for modification of the condition. 3.Heard both sides.

4.In view of the above submission made, the condition imposed on the petitioner in Crl.O.P.No.27529 of 2022 by order dated 14.11.2022, is modified to the effect that the petitioner shall deposit a sum of Rs.2,00,000/- (Rupees Two Lakhs Only) as non-refundable deposit to the credit of Crime No.428 of 2018 within a period of two weeks from the date of receipt of a copy of this order but the defacto complainant is not permitted to withdraw the said amount.
