PRAYER: This Transfer Civil Miscellaneous Petition had been filed under Section 24 of the Code of Civil Procedure Code, 1908 to withdraw the HMOP No.99 of 2021 pending on the file of Subordinate Judge at Tiruppatur, Vellore District and to Transfer the same to the Family Court Judge at Coimbatore by allowing the Transfer Petition. ORDER

This Transfer Civil Miscellaneous Petition had been filed under Section 24 of the Code of Civil Procedure Code, 1908 to withdraw the HMOP No.99 of 2021 pending on the file of the learned Subordinate Judge at Tiruppatur, Vellore District and to transfer the same to the learned Family Court Judge at Coimbatore by allowing the Transfer Petition.

2. Learned Counsel for the petitioner submits that, initially, at the instance of the respondent/wife, H.M.O.P.No.99 of 2021 was transferred from Udhagamandalam to Tirupattur and since now the respondent's father had retired and they have settled down in Coimbatore, which is also nearer to the petitioner's place of residence, H.M.O.P.No.99 of 2021 may be withdrawn from the file of the Learned Subordinate Judge Tirupattur and transferred to the Family Court at Coimbatore.

3. In this petition, notice was ordered to the respondent/wife and affidavit of service has also been filed as proof of the service effected. However, the respondent/wife has not chosen to enter appearance before this court.

Considering the fact that both the parties are stated to be residing in Coimbatore, this petition is allowed by withdrawing the HMOP and transferring the same to the learned Family Court Judge at Coimbatore.
