ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The allegation in this case is that on 20.03.2018 there was a wordy quarrel between the accused and the defacto complainant, which resulted in minor injuries on the defacto complainant. For the said allegation, Cr.No.60 of 2018 was registered for an offence under Section 294 (b), 323 and 506 (i) of IPC and Section 4 of the Tamil Nadu Prohibition of Harassment of Woman Act, 2002. The case is pending at the stage of summons. Considering the factual matrix, context of the case, the antecedents of the accused, the reason for absence from his usual place, and the submission that, despite best efforts, the summons could not be served, it is evident that even if the accused is brought to face trial, it would impinge upon his right to speedy trial. Due to the passage of time, no meaningful trial is likely to be taken place and no useful purpose would be served.

Accordingly, the CC.No.129/2018 on the file of the Judicial Magistrate Court, Dharapuram, Dharapuram Taluk, Tiruppur, stands quashed and the Suo Motu Transfer Case stands disposed of. 08.09.2025 Jer electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
