Heard.

2. This Transfer Civil Miscellaneous Petition is filed under Section 24 of the Code of Civil Procedure seeking withdrawal of H.M.O.P. No.558 of 2024 pending on the file of the Family Court,Pondicherry, and transfer of the same to the file of the Family Court, Ranipet, for disposal in accordance with law.

3. The marriage between the petitioner and the respondent was solemnized on 11.03.2022 at T.K.Padmavathi Thirumana Mandapam, Thavalakuppam, Puducherry as per Hindu rites and customs. The respondent/husband has instituted H.M.O.P. No.558 of 2024 before the Family Court, Puducherry seeking divorce on the ground of cruelty.

4. It is the case of the petitioner is that she is residing at Ranipet/Ranipet District, in her parents' house, and is taking care of a minor child aged about two years and cannot undertake repeated travel with the child.

5. The materials also show that the divorce OP was earlier proceeded ex parte on 15.07.2025, and thereafter the petitioner filed an application to set aside the ex parte order on 19.07.2025. The e-courts status produced along with the papers reflects that the Transfer CMP was listed at the stage of admission/notice.

6. In the present Transfer CMP, notice was ordered and interim stay of further proceedings in H.M.O.P. No.558 of 2024 was granted initially and extended.

7. In view of the circumstances pleaded by the petitioner-wife, particularly her residence at Ranipet and the responsibility of caring for a tender-aged minor child, and considering that the matrimonial proceedings can be more conveniently tried at Ranipet, this Court is satisfied that the transfer sought deserves to be ordered.

8. In the result, Tr.C.M.P. No.1183 of 2025 is allowed. H.M.O.P. No.558 of 2024 pending on the file of the Family Court, Pondicherry is withdrawn and transferred to the file of the Family Court, Ranipet, for disposal in accordance with law. The Family Court, Pondicherry shall transmit the entire records in H.M.O.P. No.558 of 2024 to the to the Family Court, Ranipet within three weeks from the date of receipt of a copy of this order. Upon receipt of records,

the Family Court, Ranipet shall dispose of the matter in accordance with law as expeditiously as possible , uninfluenced by any observations made in this order. Interim stay granted by this Court on 03.11.2025 shall stand vacated and consequently, C.M.P. No.26651 of 2025 is closed. No costs. 24-02-2026 Index: Yes/No Speaking/Non-speaking order MFA
