ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025.

2. The case, Cr.No.193 of 2020 was registered for an alleged offence under Section 294 (b), 353 and 506 (i) of IPC. The incident occurred on 15.03.2020. The allegation in this case is that the 1st accused who was the driver of the private bus had driven the bus in an inebriated condition and 2nd accused was the conductor of the same private bus who was also in an inebriated condition. When they were intercepted by the police personnel and they was underwent breath analyser test, it is proved that they were in an inebriated condition. Jer in filthy language. The case is pending from the year 2020. NBW was issued against the 1st accused, thereafter the case was spitted up and as against 1st accused and C.C. No. 1218 of 2025 was split up from the main case. There is no previous or subsequent case as against both the accused. Considering the factual matrix, the context of the case, any further continuation of the proceedings would impinge upon the right of the accused for speedy trial.

3. Accordingly, the proceedings in CC.No. 453 of 2020 and C.C. No. 1218 of 2025 on the file of the Judicial Magistrate Court No.I, Villupuram Taluk, Villupuram, are quashed and this Suo Motu Transfer Case is disposed of. Jer 08.09.2025 electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary. Further, the Court below is directed to dispatch the copy of this order to all concerned."
