Prayer: Writ Petition is filed under Article 226 of Constitution of India, pleased to issue Writ of Mandamus to the direct the 2nd respondent to recover the CCTV Footage installed at the parking area of the Celio Flat Owners Welfare Association, Paruthipattu, Avadi, Chennai - 600 071 in which the attack on the petitioner on 05.10.2023 was recorded and send the same to the 3rd respondent to verify its originality and return the same to the 2nd respondent and to conduct enquiry on the basis of the petitioner's complaint dated 13.10.2023 submitted to respondents 1 & 2. Writ Petition is filed seeking permission to preserve CCTV Footage installed at the parking area of the Celio Flat Owners Welfare Association, Paruthipattu, Avadi, Chennai.

2. The learned Government Advocate (Crl. Side) submitted that, petitioner herein who lodged a complaint before the respondent police and later given a letter to withdraw the complaint. Therefore, there was no necessity for the police to secure the CCTV footage connected with the complaint.

3. In view of the above submission, the Writ Petition is dismissed. However, the withdrawal of the complaint shall not be a bar for the police to look at the CCTV footage, if any cognizable offence is made out.
