When the matter is taken up for hearing, the learned Special Public Prosecutor for CBI brought to the knowledge of this Court that the petitioners have also filed the discharge petition on the same grounds which is pending before the trial Court.

2. Learned counsel appearing for the petitioners sought permission of this Court to withdraw this petition and he prayed that liberty may be given to the petitioners to pursue the petition for discharge. He has also made an endorsement in the case bundle to that effect.

3. In view of the above submissions and the endorsement made by the learned counsel for the petitioners, this Criminal Original Petition stands dismissed as withdrawn with a liberty to the petitioners to pursue their discharge petition.
