ORDER

The petitioner, who was arrested and remanded to judicial custody on 30.03.2025 based on execution of NBW in P.R.C.No.8 of 2017 on the file of the Learned Judicial Magistrate No-I, Ulundurpet, Kallakurichi, for the offences punishable under Sections 147, 148, 332, 307 of IPC r/w 9B(1)(b) of Exp Act, 1978 in Crime No.296 of 2009, registered on the file of the respondent police, seeks bail.

The learned counsel appearing for the petitioner submitted that originally the petitioner was arrested and released on bail and was regularly appearing before the Trial Court for the case in P.R.C.No.8 of 2017 and due to his non-appearance before the Trial Court on 30.11.2020, a NBW was issued as against the petitioner and subsequently, the petitioner was arrested on 30.03.2025. He further submitted that the petitioner is ready to abide by any conditions that may be imposed by this Court and sought for bail to the petitioner.

The learned Government Advocate (Criminal Side) appearing for the respondent while opposing the bail to the petitioner submitted that 2/4

since the petitioner failed to appear before the Trial Court, a NBW was issued and subsequently, he was arrested. He further submitted that there are totally five accused in this case and the petitioner herein arrayed as A2 and the case against A4 and A5 were split up and the petitioner along with accused A1 and A2 are facing trial in P.R.C.No.08 of 2017 and further the petitioner has absconded for more than 4 years. 4.

Considering the facts of the case, the charges against the petitioner, the petitioner has absconded for more than four years and taking note of the fact that the case being 16 years old case, this Court is not inclined to grant bail to the petitioner.
