Prayer : Writ Petition (Criminal) filed under Article 226 of the Constitution of the India, praying to issue a Writ of Mandamus, directing the 5th Respondent to investigate with respect to grant of benefits under Kalaignar Kanavu Illam to the 6th respondent and to take necessary action against the 6th respondent for having fraudulently obtained funds under Kalaignar Kanavu Illam Scheme by suppression of materials facts in respect of the property situated at D.No.5/39, Bajanai Koil Street, Mangaddu Village, Arcot Taluk, Ranipet bearing S.No.425/2 part, New S.No.425/17 bearing Joint Patta No.554 measuring an extent of 5197.08 sq.ft of land as per the guidelines issued in G.O.Ms.No.173 P and AR(N) Department, dated 09.12.2018 on the file of the 1st respondent and provision of DVAC Manual on the file of the 5th respondent pursuant to the representation of the petitioner dated 27.01.2025. ORDER
This Writ Petition (Criminal) has been filed seeking a direction to the fifth respondent to conduct an investigation with respect to the grant of benefits under Kalaignar Kanavu Illam to the sixth respondent and to take necessary action against the sixth respondent for having allegedly obtained funds under the said Scheme fradulently by suppressing material facts in respect of the property situated at Door No.5/39, Bajanai Koil Street, Mangadu Village, Arcot Taluk, Ranipet District bearing Survey No.425/2 Part, New Survey No.425/17
bearing Joint Patta No.554 measuring an extent of 5197.08 sq.ft. of land as per the guidelines issued in G.O.Ms.No.173 P & AR (N) Department dated 09.12.2018 on the file of the first respondent and the provisions of the DVAC Manual on the file of the fifth respondent, pursuant to the representation submitted by the petitioner dated 27.01.2025. 2.
Heard the learned counsel appearing on either side and perused the materials available on record.

On receipt of the said complaint, the fifth respondent forwarded the same to the second respondent and sought a report after conducting an enquiry. Now, the complaint is pending on the file of the second respondent. 4.
On instruction, the learned Counsel for Government of Tamil Nadu (Criminal Side) submitted that the petitioner lodged a complaint against the sixth respondent. Both the petitioner and the sixth respondent are private individuals and are not working in any department. 5.
The learned counsel for the petitioner submitted that the sixth respondent, in collusion with the officials, cheated the petitioner and did not extend the benefit under the Kalaignar Kanavu Illam Scheme to the petitoner.

The learned counsel appearing for the third respondent submitted that the sixth respondent is one of the beneficiaries under the Kalaignar Kanavu Illam Scheme and that a civil suit is also pending between the petitioner and the sixth respondent.

In view of the above, the second respondent is directed to submit a report to the fifth respondent on the complaint forwarded by the fifth respondent within a period of four weeks from the date of receipt of a copy of this order, after conducting an enquiry. On receipt of the same, the fifth respondent is directed to act in accordance with the report submitted by the second respondent.

With the above direction, this Writ Petition (Criminal) stands disposed of. No costs.
