O R D E R

The petitioners, who were arrested and remanded to judicial custody on 05.08.2025 and 07.08.2025 respectively for the offences punishable under Sections 194 BNS altered to 108 of the Bharatiya Nyaya Sanhita(BNS) 2023 in Crime No.481 of 2025 on the file of the respondent police, seek bail.

2. The petitioners are in-charge of gambling club in which the deceased was working as a menial. He has committed suicide leaving suicide note implicating the petitioners. Hence, the police has arrested the first accused on 05.08.2025 and the second accused on 07.08.2025.

3. The learned Government Advocate (Crl.Side) submitted that the investigation is at a crucial stage and the suicide note left by the deceased mentioned the petitioners and other accused need to be examined through the Forensic Expert.

4. Considering the nature of the issue, the investigation is required to be done by a well-trained investigator. Hence, this Court is of the view that while dismissing the petition, this Court directs the Commissioner of Police to 2/4

transfer the investigation to the officer not below the rank of Deputy Superintendent of Police.

5. In the result, this Criminal Original Petition is dismissed with the above direction.
