ORDER

This Contempt petition has been filed alleging violation of the order dated 10.06.2024 in W.P.No.26057 of 2019, whereby this Court passed the following order:

"In the light of the above, this Court is of the considered view that on setting aside of the conviction by allowing the appeal filed of the petitioner by the Hon'ble Apex Court as noted above by order dated 15.12.2023, the impugned order herein has lost its basis and consequently, the same is liable to be set aside and the same is accordingly set aside. The respondent is directed to reinstate the petitioner into service as expeditiously as possible at any rate within a period of four weeks from the date of receipt of a copy of this order. It is made clear that the petitioner shall not be entitled for any emoluments for the period during which the petitioner is out of service. However, the same shall be counted for all other purposes."

2. The learned Government Advocate appearing for the respondent filed an affidavit stating that the petitioner has already been reinstated and her pay also fixed, taking into consideration the period which the petitioner was out of the service through proceedings Na.Ka.No.05/2025 dated 17.02.2025. It is also stated in the affidavit, stating that the period during which the petitioner was out of the service, is also taken into consideration for the purpose of pensionary 2/5

benefits and other related matters. However, there appears to be some delay. The said delay in complying with the order is satisfactorily explained by filing an affidavit dated 06.06.2025 along with dates and events.

3. This Court having perused the same, convinced that there is no deliberate delay caused by the respondent in complying with the order passed by this Court.
