C.M.P.No.2979 of 2024 in C.R.P.No.2654 of 2016 BATTU DEVANAND, J This civil Miscellaneous Petition has been filed seeking to restore the above C.R.P.No.2654 of 2016.

2.This Court by its order dated 06.12.2022 dismissed the above C.R.P. In view of the fact that the main suit was dismissed for default in the Court below and liberty was granted to the learned counsel for the petitioner to revivew the C.R.P. if the suit is restored. 3.The learned counsel for the petitioner submits that the present Restoration Petition is filed in view of the fact that the suit was restored in the Trial Court by order dated 16.06.2023.

4.In the light of the liberty granted by this Court in its order dated 06.12.2022 to revive the C.R.P. when the suit is restored, the petitioner is entitled to restore the present C.R.P. Accordingly, this Petition is allowed and the C.R.P.No.2654 of 2016 is restored to its file. 5.Post the main C.R.P. On 15.07.2024.
