ORDER

Challenging the condition imposed by the trial Court while returning the vehicle to the petitioner to produce the vehicle once in a month, the present Criminal Original Petition has been filed.

2. The vehicle of the petitioner was seized on the ground that after the registration of the present case, he had purchased the vehicle. The vehicle was returned to the petitioner with a condition to deposit the RC book and also a condition has been imposed to the effect that the petitioner shall not alienate the vehicle till the disposal of the case. Further, the petitioner has to produce the vehicle before the Court on the first working day of every month.

3. It is the contention of the learned counsel appearing for the petitioner that he had already deposited the RC Book and also given necessary undertaking before the Court. Hence, he seeks modification of the condition for production of the vehicle once in a month.

4. I have perused entire material. The RC book of the vehicle has already been deposited before the trial Court. Therefore, when the original RC Book has already been deposited, this Court is of the view that it is not possible for any one to alienate the vehicle. In such view of the matter the said condition has to be set aside.

5. Accordingly, this Criminal Original Petition is allowed and the condition No.7 imposed in Crl.M.P.No.4138 of 2023 dated 15.12.2023 by the learned Special Judge under the Tamilnadu Protection of Interest of Depositors [in Financial Establishment] Act 1997, alone is set aside. All other conditions remain unaltered.
