Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus directing the respondents to reimburse the sum of Rs. 1,47,984/- towards the medical claim submitted by the petitioner with regard to the medical treatment undergone by her husband Mr.M.Karunanidhi with interest for the belated payment at the rate of 12% per annum and pass orders.

Writ Petition is filed for issuance of a Writ of Mandamus to direct the respondents to reimburse the sum of Rs. 1,47,984/- towards the medical claim submitted by the petitioner with regard to the medical treatment undergone by her husband Mr.M.Karunanidhi with interest for the belated payment at the rate of 12% per annum and pass orders.

2. Heard both sides and perused the records. By consent, the writ petition is taken up for final disposal.

3. The case of the petitioners is that the petitioner is working as Anganwadi Worker, Kalukarai Anganwadi Centre, Tiruppur. Her husband namely M.Karunanidhi underwent two major surgeries. She is a subscriber to the New Health Insurance Scheme and subscription amount is being deducted from her salary every month. She incurred a expenditure of Rs.1,47,984/- towards the surgeries and medical treatment for her husband. Sine the petitioner's request was denied by the MD India Health Care, she sought for reimbursement before the District Level Empowered Committee. The said Committee by its communication dated 29.05.2015, has rejected the request of the petitioner. Subsequently, she sent request to the Director, Integrated Child Development Scheme, Tharamani, which in turn forwarded the request to the 1st respondent/ Commissioner of Treasuries and Accounts, Nandanam, Chennai. Since the same was not considered by the 1st respondent till date, this writ petition is filed.

4. Learned counsel appearing for the petitioner submitted that it would suffice, if this Court issues direction to the first respondent to consider the petitioner's appeal and pass appropriate orders within the reasonable time.

Considering the limited request made by the learned counsel appearing for the petitioner, this Court hereby directs the first respondent to consider the request made by the petitioner for reimbursement and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
