O R D E R

The Criminal Original Petition has been filed to set aside the order passed by the learned Principal District and Sessions Judge, Vellore in C.R.P.No.6 of 2016 by confirming the order of the learned Judicial Magistrate No.II, Vellore in C.M.P.No.1511 of 2015 dated 24.02.2016 and consequently discharge the petitioner herein.

2.It is seen that the petitioner filed discharge petition before the trial Court in C.C.No.22 of 2010 and the same was dismissed. Aggrieved the said order, the petitioner preferred a revision in C.R.P.No.6 of 2016 and the same was also dismissed. The said order was challenged by this petition. Pending this petition, trial commenced and also examined prosecution of witness. Therefore, discharge of the petitioner does not arise. https://hcservices.ecourts.gov.in/hcservices/

3.In view of the above, the prayer sought for by the petitioner has become infructuous. Accordingly, this Criminal Original Petition is dismissed as infructuous. Consequently, connected miscellaneous petition is closed.
