Prayer Writ Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus, directing the 4th respondent to conduct survey and demarcate the four boundaries of the property situated in Survey Nos.151/2A, 152, 154/4 at Kappiyakudi Village, Arasur Sirgazhi Taluk, Mayiladudurai District For Petitioners : Mr.R.Ramkumar For Respondents : Mr.P.Ganesan Government Advocate Order Heard Mr.R.Ramkumar, learned counsel appearing for the petitioners and Mr.P.Ganesan learned Government Advocate, who takes notice on behalf of the respondents. With consent, the main Writ Petition is taken up for final disposal at the stage of admission itself.

2. This Writ Petition is filed seeking for issuance of a mandamus directing the 4th respondent to conduct survey and demarcate the four boundaries of the property situated in Survey Nos.151/2A, 152, 154/4 at Kappiyakudi Village, Arasur Sirgazhi Taluk, Mayiladudurai District. 2/6

Learned counsel for the petitioner would submit that the petitioners are the owners of the subject property (morefully described in para No.2 of this order), since, one of the petitioners neighbour is attempting to trespass into the petitioners' property, the petitioners made a written representation to the third respondent on 12.06.2023, seeking for demarcation of the property, however, as on date, no action has been taken by the third respondent in pursuance of such representation, which necessitated the petitioners to approach this Court by way of present Writ Petition seeking for aforesaid relief. It is further submitted that the petitioner also paid required fee towards survey of the property and therefore, seeks for appropriate direction.

4. Learned Government Advocate for respondents fairly submitted that the prayer sought for by the petitioner would be considered and appropriate steps would be taken by the respondent-Authorities, if a direction is issued in that regard.

In view of the submission made by the learned counsel on either side coupled with the fact that the petitioners have paid necessary charges for demarcating the property on 24.04.2025, this Writ Petition is disposed of with a direction to the third respondent to forward the petitioners' representation dated 12.06.2023 to the fourth respondent, who, in turn, is directed to consider such representation and take suitable steps for conducting a survey in the petitioners' property and demarcate the same by metes and bounds after giving notice to all the interested parties, within a period of two weeks from the date of receipt of a copy of this order. It is needless to say, in the event, any obstruction is caused by any third parties, the Official Respondents are at liberty to seek the assistance of the Police Officials, in which case, the concerned Jurisdictional Police is directed to render all kinds of assistance, as required, by the Revenue Officials for demarcation of the subject property. No costs. Consequently, connected Miscellaneous Petition is ordered.
