ORDER

This Suo Motu Case is dealt with in an extraordinary manner by the Dedicated Bench, pursuant to Suo Motu W.P.(Crl.) No.618 of 2025. 2.The case, Cr.No.174 of 2018 was registered for an alleged offence under Section 454, 511 and 380 of IPC. The incident occurred on 20.03.2018. The allegation in this case is that the accused broke open the door of the defacto complainant's house and attempted to steal the properties. The case is pending from the year 2019 and now it is posted at the summons stage. Now, the defacto complainant could not be traced in the present address. Considering the factual matrix, the context of the case, the background of the accused, the reason for his absence at his place of residence, and the submission made that, despite best efforts, the summons could not be served, it is clear that even if the accused faces trial, no useful purpose would be served. Accordingly, the proceedings in CC.No.4458/2019 on the file of the X METROPOLITAN MAGISTRATE COURT, Egmore Taluk, Chennai, is quashed and this Suo Motu Transfer Case is disposed of. 08.09.2025 Jer electronically alone. The Trial Court shall take note of the order and accordingly classify the case pending before them as allowed / dismissed / disposed of, etc, and while doing so, consider any applications such as disposal of properties, etc., and pass appropriate orders, as may be necessary.
