The petitioners, who were arrested and remanded to judicial custody on 17.03.2022 at the hands of the respondent police for the alleged offences punishable under Sections 8(c), r/w 22(a), 22(c), 29(1) of Narcotic Drugs and Psychotropic Substances Act, 1985 and Sections 465, 468, 472 of IPC in Crime No.81 of 2022 on the file of the respondent police, seek bail.
2. The case of the prosecution is that on 17.03.2022 at about 9.00 a.m. when one of the accused was selling banned drugs at Kodambakkam Trustpuram Play Ground, the respondent police arrested the accused and recovered Nitravite and Tydol tablets. Based on the information from that accused, the petitioners and other accused were arrested. Hence, the complaint.
3. The learned counsel for the petitioners would submit that there are totally six accused involved in the alleged offence, wherein the petitioners have been arrayed as A5 and A4. He would further submit that the petitioners are no way connected with the alleged offence and a false
case has been foisted against them. Hence, he prays for grant of bail to the petitioners.

The learned Additional Public Prosecutor would submit that the petitioners and other accused were found in joint possession of Nitravet - 10 mg (150 tablets) and Tydol-100 mg (100 tablets) illegally. Though, they possessed separately of certain quantities, in total, all the accused possessed contraband which are of commercial quantity. He would further submit that the earlier petitions filed by the petitioners were dismissed by this Court. Hence, he vehemently opposed to grant bail to the petitioners.

Considering the facts and circumstances of the case and also considering the serious nature of offence committed by petitioners and this Court had dismissed the earlier petitions filed by the petitioners and that there is no change of circumstances, this Court is not inclined to grant bail to the petitioners.
6. Accordingly, these Criminal Original Petitions are dismissed. 01.12.2022 mn
