O R D E R

This Criminal Original Petition has been filed to direct the 2nd respondent police to register the FIR on the petitioner's complaint dated 08.10.2022.

2. Heard the learned counsel for the petitioner and the learned Government Advocate (Crl.Side) appearing for the respondents.

The learned counsel for the petitioner submitted that the petitioner is a fish seller; one Vekatesan and two others have demanded 5 kg of prawn fish for free of cost; since the petitioner refused to give the prawns, the said persons along with others had trespassed into the petitioner's house on 02.10.2022 and 07.10.2022, abused the petitioner with filthy language and assaulted her and her husband was also taken by them in the police jeep.

4. The learned Government Advocate (Crl.Side) appearing for the respondents submitted that the accused are police constables and the petitioner's husband by name Gunasekar is a history sheeter rowdy and the police had gone in search of him at the petitioner's house; but the petitioner 2/4

had made a false complaint by stating that they had assaulted her; after enquiry the case has been closed as mistake of fact on 24.11.2022.

5. However, the learned counsel for the petitioner submitted that the enquiry has not been fairly done and many facts have been suppressed.

6. Under these circumstances, if the petitioner is not satisfied with the final report, the petitioner is at liberty to invoke Section 156(3) & 200 Cr.P.C and initiate appropriate proceedings before appropriate forum.

7. With the above directions, this Criminal Original Petition is disposed of.
