O R D E R
The petitioner, who was arrested and remanded to judicial custody on 23.07.2025 for the alleged offence under Section 8(c) and Section 20(b)(ii)(B) of the Narcotic Drugs & Psychotropic Substances Act, 1985 in Crime No.252 of 2025, on the file of the respondent police, seeks bail.
2. The allegations against the petitioner is that the petitioner was 1/4
found in possession of 1.250 kgs of ganja and the same has been sold to the local public for his personal gain. Hence, the case.
3. The learned counsel appearing for the petitioner submitted that the petitioner is an innocent person and he has been falsely implicated in this case. He further submitted that the petitioner has been in judicial custody from 23.07.2025 and he is ready to abide by any stringent condition that may be imposed by this Court. Hence, he prayed for grant of bail to the petitioner.
4. The learned Government Advocate (Criminal Side) appearing for the respondent police reiterated the prosecution case and reported that the seized contraband is an intermediate quantity. He further reported that the petitioner is having two previous cases under Section 304(A) of BNS, 2023 and if the petitioner is released on bail, there is every possibility of tampering the witnesses. He further reported that final report not yet filed. Hence, he opposed to grant bail to the petitioner.
5. Heard both sides and perused the materials available on record.
6. Taking into consideration the facts and circumstances of the case and the submissions made by the learned counsel on either side, the gravity of offence committed by the petitioner and also taking note of the fact that 2/4
the seized contraband is an intermediate quantity and the petitioner is having two previous cases and so far final report not yet filed, this Court is not inclined to grant anticipatory bail to the petitioner.
