This Criminal Original Petition has been filed to call for the records connected to the Crime No.79 of 2017, on the file of the respondent police, Thalayamangalam and quash the same.

The learned counsel for the petitioner submitted that First Information Report in Crime No.79 of 2017 was registered against the petitioner and 15 other accused for the offences under Sections 143, 186, 188, 353, 153, A(1)(b) of IPC. He further submitted that all the offences are punishable for a period less than 3 years of imprisonment. Though the First Information Report was registered on 24.09.2017, final report is not yet filed in this case so far. Therefore, he filed this petition to quash the First Information Report.

3. However, this Court is not in a position to ascertain as to whether the final report is filed in this case or not. It is not that the petitioner's case is not without merits. Therefore, the petitioner is directed to approach the learned concerned Magistrate with an appropriate petition for closure of the First Information Report on the ground of limitation.

4. In such view of the matter, this Criminal Original Petition is disposed of. Consequently, the connected Miscellaneous Petition is closed. 08.12.2022 Index:Yes/No Speaking/Non speaking order gd 2/4
