Appeal under Clause 15 of the Letters Patent against the order dated 23.9.2019 passed by the learned Single Judge in W.P.No.18233 of 2019.

W.P.No.18233 of 2019:- This Writ Petition filed under Article 226 of Constitution of India, praying to call for the records of the respondent pertaining to the Na.Ka.No.15904/PTho.3/Iru.2/2018, dated 09.06.2019 passed by the 1st respondent and quash the same and consequently to direct the respondent to retain the petitioner in service at Thiruvannamalai.

JUDGMENT

(Delivered by The Hon'ble Chief Justice) Heard learned counsel for the appellant and the learned counsel for the State.

2. It is trite law that transfer is an exigency of service and we, therefore, find no reason so as to warrant an interference with the impugned order, but keeping in view the submissions raised at the bar that the appellant has a six month old child, we provide, as suggested by the learned Single Judge, that it will be open to the appellant to move a representation before the competent authority for reviewing the transfer order and in the event any accommodation can be granted, the same shall be considered sympathetically.

The writ appeal is disposed of with the above said observations. No costs. Consequently, C.M.P.No.24066 of 2019 is closed.
