Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Certiorarified Mandamus Calling for the records of the 3rd respondent relating to the petitioners memo No.250/ADM 2/A1/F - Suspension/2017 dated 14.06.2017 and quash the same, as illegal, unwarranted, biased, malafide, arbitrary and without any jurisdiction. O R D E R

The petitioner has filed this writ petition seeking to quash the Impugned order passed by the 3rd respondent relating to the petitioners memo No.250/ADM 2/A1/F - Suspension/2017, dated 14.06.2017.

2. The learned counsel for the petitioner submitted that the writ petition has been filed against the order of suspension dated 14.06.2017 issued by the 3rd respondent. Subsequently, disciplinary proceeding has been concluded and the petitioner was dismissed from service. Aggrieved by the said dismissal order, the petitioner filed a writ petition No.31328/2019 which is pending before this Court for adjudication.

3. In view of the submission made by the learned counsel for the petitioner, it appears that during pendency of the writ petition which was filed against the order of suspension, the respondents have concluded the disciplinary enquiry against the petitioner and he was terminated from service. As against the said dismissal order, the petitioner has filed another writ petition and the same is pending.

4. In such circumstances, the present writ petition filed by the petitioner has become infructuous and accordingly, the sane is dismissed as infructuous.

No costs.
