P.B.Raghunatha .. Applicant/plaintiff Vs 1.Geetha 2.Kothai .. Respondents/Defendants The plaintiff has filed this application seeking to condone the delay of 638 days in submitting reply statement to the counter claim.

2. The learned counsel for the respondents strongly objected for allowing this application on the ground that the delay of 638 days in submitting reply statement has not been properly explained.

3. It is seen from the affidavit filed in support of this application that the parties have been referred to for mediation, wherein, after several rounds of deliberations, it has ended in failure, and the said mediation process has ultimately caused a delay in submitting reply statement to the counter claim made by the defendants. Therefore, having satisfied with the reasons stated in the affidavit filed in support of this application, the delay of 638 days in submitting reply statement to the counter claim made by the defendants is condoned and this application is allowed accordingly. Reply statement filed by the plaintiff against the counterclaim made by the defendants is taken on record. Post the matter on 24.11.2025.
